Contract
This Contract is entered upon the below stated date between Brandi Pompa(Brandi Kay Photography) hereinafter referred to as “The Photographer” and the below named client hereinafter referred to as “The Client”.
Additional Costs
The Client agrees to reimburse The Photographer for any additional cost the photographer may incur for travel, meals, parking, and other reasonable costs necessary to the performance of these services.
Deposit
Any deposit retained is not refundable if The Client cancels or changes the engagement. If The Photographer fails to appear at the place and time specified above, the deposit shall be refunded to the client.
Gallery Availability
Photographs are guaranteed to be available to The Client via online gallery up to 3 months after photographer turn over. After 3 months a $25 fee is charged to retrieve photos. The Client has unlimited but non-exclusive rights to use or reproduce the photographs and may print or use them in any way they see fit.
Client Cooperation
The Client shall assist and cooperate with The Photographer in obtaining the desired photographs, including but not limited to specifying persons and/or scenes to be photographed; taking time to pose for photographs at The Photographer’s direction; pre-shoot consultations, etc. The Photographer is not liable for photographs not rendered as a result of the client’s failure to provide reasonable assistance or cooperation.
Force Majeure
Neither the Client, nor The Photographer shall be liable for any default, delay or lapse occurring due to events beyond their control including riot, strike, theft, war, or acts of God and/or nature.
Copyright
The Photographer retains copyright in the photographs, and hereby grants The Client unlimited but non-exclusive rights to use or reproduce the photographs for which The Client pays.
Applicable Law
The Client and the Agency shall comply with all statutory regulations. This contract shall be governed by the laws of the Galveston County in the State of Texas and any applicable Federal Law.
